When she and her husband called me, she thought that she qualified for benefits under CSPA. Initially, I was skeptical. economy has slowed down immigration. Otherwise, numbers were pretty high.

Can anyone tell me if a PERM is first audited, and then reaudited, which one will be used for the priority date? the first one or the second one? or it does not matter (based on the date when the PERM was first filed)?

I got my 140 approved.Is there any deadline date like with in 90 days i have to apply for 485 or else it will expire.I am single so i dont want to get in to any trouble by applying for 485.
Please suggest me what i have to do.

Folks,
Pretty soon I'll have to relocate to another city (same job). Wondering if I should continue using my H1B (valid till 2010) or should I use AC-21 to relocate ?
My attorney insists that I use AC-21, and she states that if something goes south during my Adjustment of Status I can re-file for my H1 and she did state the refiling H1 will be exempt from Annual Numerical Limits as I have been on Non-Immigrant visa in the past 6 year and haven't stayed outside the country for over an year.
Is this something I can rely on? Also, what happens to pending AOS(485) if I use this option to refile my H1 from EAD status?

"Has the beneficiary of this petition been previously granted status as an H-1B nonimmigrant in the past 6 years and not left the United States for more than one year after attaining such status?"

If my priority date is current based on March visa bulletin, till what date can I file for my 485? Do I have time until end of April?
You can file anytime after your dates are current.. Just don't take too long though, Remember if the dates retrogress again, then might get out of luck! Again!! So file it right away if you can...

The big news today was Senator Reid now backtracking and promising climate change legislation before immigration reform. But in a seeming effort to show the Democrats are close to ready to go on immigration reform, Senators Reid, Schumer and Menendez began circulating a detailed outline of a comprehensive immigration reform bill that appears to exclude Senator Graham. There are many positive things in the plan, a few worrisome ones and several new concepts. Incidentally, the new two stage legalization process looks very familiar. Tours, exhibits and commemorative plaques in the Capitol should recognize the contributions of slaves in constructing Congress' home, experts told a House committee Wednesday.
Such citations would help encourage blacks to make a historical connection to the building, a congressional task force said.
Sarah Jean Davidson, founder of the Association for the Preservation of North Little Rock, Ark., African American History, said blacks and others feel the Capitol and some historic buildings belong more to whites.
"We can say our ancestors helped build the Capitol so when we look at it, it's not 'your building, the majority', it's our building," Davidson said.
"It will be a connection not just for African-Americans, but for immigrants who come from all around the country. ... Once they start feeling connected, then we are one," she said.
Congress created a task force to commemorate slaves' work on the Capitol. Panelists recommended that the history be included in guided tours, educational materials, exhibits, plaques and showcases in the Capitol Visitors Center.
The recommendations were released at a hearing of the House Administration Committee.
"We look back today not to open wounds, but to ensure that we tell the story of those slaves so their toil is never forgotten," said Rep. John Lewis, D-Ga. "We cannot allow our citizens to leave without an appreciation for the efforts of slaves who helped build our 'Temple of Freedom.'"
Financial records of the District of Columbia show that hundreds of local residents received payments for the slaves' work, said William Allen, the architectural historian of the Architect of the Capitol's office.
The ledger recorded the payments as "Negro hire," Allen said.
Many worked in quarries where they extracted the stone for the building. Others provided carpentry skills. Some slaves were stationed in pits from where, with a partner above ground, they would use a whipsaw to saw logs rolled over the pit. Slave women and children were used to mold clay in kilns, Allen said.
